New Legislation Effective November 2026

A provision included in a federal spending bill, signed by President Trump in November 2025, significantly tightens the rules for hemp products, including beverages. This new law Continuing Appropriations, Agriculture, Legislative Branch, Military Construction and Veterans Affairs, and Extensions Act, 2026 beginning on page 134, redefines hemp.

  • Redefines legal hemp: It applies the 0.3% THC limit to total THC (including delta-8 and other isomers), not just delta-9 THC, on a dry weight basis.
  • Imposes a per-container limit: It prohibits products containing more than 0.4 milligrams of total THC per container, regardless of the percentage by weight.
  • Bans most existing products: Most current hemp beverages and edibles contain between 2.5mg to 10mg of THC per serving, which far exceeds the new 0.4mg limit, meaning the vast majority will become federally illegal once the law takes effect in one year (November 2026).
